“The decision of the Court of Justice of the European Union against the freedom of religion and belief of women wearing headscarf is unfortunate in many ways. The Court of Justice and some other European institutions had similar decisions in the past as well.
Such decisions clearly violate the fundamental rights and freedoms of the Muslims living in Europe. These decisions will have negative implications on social peace and the coexistence of people with different sets of beliefs, and will lead to belief-based discrimination.
The freedom of religion and belief, which is protected under the UN Covenant on Civil and Political Rights as well as the European Convention on Human Rights, does not solely refer to the fact that individuals commit to a certain religion or a belief system in their own inner world. These conventions also cover the freedom of manifestation of such belief or religion by means of personal or communal worshiping in public or private spaces, practicing and fulfilling the requirements of their beliefs and teaching them."
